NorVergence Lessee Listserve Reactions

“I was going to fight, I was going to win I wasn't going to give in.
Then my attorney and CPA advised me "never let a judge or a jury
determine the outcome of something that you can reasonably settle on
your own."  I word to the wise.  Yes I settled with US Crapcorp for
15cents on the dollar and it kills me every month that I sign the
check for $257.49 but such is life.”

“Add me to the list of people receiving the NY Popular Leasing settlement offer of forgiving 85% of the lease balance plus all unpaid late fees and insurance charges. Basically this mess goes away for $ 2460.00. But like David, I am a hardliner that feels like giving any money to Popular is like paying the crook to get your stolen car back.”

“Believe it or not, I am really on the fence with this one. On one hand I am confident that Popular Leasing committed insurance fraud against my company for billing us for 6 months of insurance charges after they cancelled my policy. I know that I did not receive any savings as my phone numbers were never ported away from my local provider.”

“My attorney in Missouri advised me that while he is extremely confident that ultimately we will prevail the costs and time to prevail must be taken into consideration. I am a businessman first but oh would I love the opportunity to square off against Popular's lawyers with the evidence I have amassed. Financially we can handle the costs, but in the end is it all worth it to spend time away from what makes us successful?”

“I took the settlement from CIT nine months ago. I, like you, was on the fence as I wanted the leasing companies to feel our pain. But, we needed closure. $2500.00 over 18 months (no interest) would make this long ass nightmare come to an end. I gladly make that check out each month for my peace of mind.”

“We have recently been offered through registered letter a $5,286.00 negotiated pre-trial settlement buy-out of our original $24,600.00 lease through the lawyer we retained in Missouri for our pending Popular Leasing case.

“As Kit has loosely stated or at least tried to convey to us in many previous posts, 'you eventually will arrive at a point when have to look at your ROI (Return on Investment) and what you are likely to recover from this situation and when it is likely to come. That point has sadly come clear to me this past week.

“The letter we received from our lawyer outlined our proposed settlement amount, then went on to state approximate court costs for an average 2-day trial. To that end I added my own personal time and expenses involved in being there for those 2-days, and in the final outcome it just wasn't worth it any more.

“ I (we) gave in, broke down and paid this final "limited time" offer, not because I didn't want to have my day in court, but because I started wondering how much more time was going to pass before a decision would be rendered and then if an appeal was filed, how much time, etc. etc.

“Now that we have decided to pay this settlement has been made, I feel that I have left each of you down but I feel that we just had to move on and get on with the business of doing business! It simply wasn't worth the daily aggravation in just ‘not knowing" anymore.'”

“You would be foolish not to accept terms that allow you to escape
this mess and secure your business interest.  Congratulations and
best of luck.”
