Jeffrey Joseph Wong---"San Francisco Chronicle"

WONG, Jeffrey Joseph Wong -- Partner at Cooper, White & Cooper, a San Francisco Law Firm. Jeffrey passed away on November 16th at the age of 58, as a result of a massive heart attack.

He died in the arms of his beloved life partner, Lynne "Rocky" Randall at their home in Sausalito.

He is survived by his loving parents, Joe and Lily Wong, cherished sister Judy Wong, nephews Jeffrey, Kelly and David as well as Rocky and his six stepchildren Sean, Courtney, Julie, Jessica, Jennifer and Jackie.

He was a graduate of Princeton, class of '65 and UC Hastings College of Law. An avid golfer, he was a long time member of the Presidio and Olympic Golf Clubs. Jeffrey's amazing sense of humor, generosity of spirit and joie de vivre, made him a special favorite among the many clubs and organizations to which he belonged.

The Bohemian Club was central to his life and he was a talented and gifted comedian. He will be greatly missed by Bohemians, family and friends who enjoyed his great comic spirit and wit.

FTC vs. IFC---another Wallop, Mr. Estok?

The newsworthy event reported by Leasing News and others last Friday regarding the Federal Trade Commission investigation of IFC Credit Corporation, Morton, Illinois, basically was the next legal action in obtaining information requested regarding NorVergence leases; judicial enforcement.

According to senior FTC attorney Randall H. Brook, the case was filed out of the main office in Washington, DC. He was not informed it was actually filed until this week, Friday being a holiday, and electricity off in parts of Seattle, Washington, where he is located.

He did sign it and communicate with his main office on the action, which he considered quite serious as "we have gone public that we have been investigating IFC Credit for over a year."

He says they have accumulated enough evidence, including witnesses, to result in major action against this leasing company.

He stated it should give a "warning" to others that they too are being investigated, and while many think "stonewalling" will work, the FTC has filed several serious briefs with authorization to treat all NorVergence lessees as "consumers" who were deceived by various leasing companies.

Randall H. Brook said he had read Leasing News latest editorial, and although he was a cat lover, he could make no comment, but did conclude:

"I can say I agree with the opinion about the value of the internet to attorneys... speaking up for their behalf, not feeling they are alone, or having to re-invent or discover rulings and facts, ( and ability to pool resources) has certainly changed the playing field."

Leasing News attempted to reach both IFC President/CEO Rudy Trebels and John Estok, Executive Vice President, who we were told was more directly handling "the matter." No calls were returned. It should be noted the last time we talked with Mr. Estok he wanted the Leasing News Advisory Board to fire this writer for what he wrote about IFC Credit losing its claim to the Bankruptcy Court to the Federal Trade Commission.

In the IFC Credit situation, they reportedly have leases with "A" and "B" credits with a 25% return (not counting residuals or any extra fees, such as insurance, usurious late charges, or deceptive practices in the collection of payments.)

The key revelation, according to Brook, is the FTC declaration is his assignment "...to the FTC's Non-Public Investigation of the Acts and Practices of Unnamed Persons or Entities in Connection with the Offering, sale, or Financing of Telecommunication Services and Products by NorVergence, Inc."

This indicates other leasing companies also are under serous investigation. He was not able to divulge any names until actual filing has taken place.

The situation with the recent filing concerns the alleged non-response by IFC Credit and their attorneys to information requested. In the document, it is noted, "In a letter dated October 8, 2004, IFC's attorney Vince Borst indicated that IFCE would produce additional responsive material after completing a privilege review.

"6. In November 2004, the Commission initiated an action against NorVergence in federal district court, alleging that the company had defrauded consumers through false and misleading claims that it would provide them with substantial on long-term savings on telecommunication services, in violation of Section 5 of the FTC Act. As detailed in the complaint, NorVergence claimed that part of the savings would be generated by a "Matrix" black box that it would install on customers' premises; but in reality the black boxes were nothing more than standard telephone routes, which NorVergence rented to customers for inflated prices. The complaint also alleged that NorVergence unlawfully provided others with the means an instrumentalities for the commission of deceptive and unfair acts or practices by furnishing third-party finance companies with rental agreements from consumers that allowed the finance companies: (a) to misrepresent that consumers owe money on the rental agreements regardless of whether NorVergence provided the promised telecommunication services, and(b) file collection suits against consumers in distant forums, which made it difficult for customers to dispute the monthly rental fees. This action ultimately ended in default judgment against NorVergence in July, 2005.

". On February 22, 2005, I wrote to Mr. Borst, asking for information on the status of IFC's production of documents in response to the Commission's September 2, 2004 letter. I also identified several additional categories of information that the Commission required from IFC in connection with its investigation. I received no reply to this letter."

On March 22, 2005, the FTC "...issued a Resolution Directing the Use of Compulsory Process in Non-Public Investigation of the Acts and Practices of Unnamed persons or Entitles in Connection with the Offering, Sale, or Financing of Telecommunication Services and Products by NorVergence."

June 28, 2005 Mr. Borst was informed by telephone and letter the FTC had never received the documents in question.

August 8, 2005, the FTC issued information directly from IFC President and CEO, Rudolph D. Trebels.

September 19, 2005, "...my office sent a letter to Mr. Borst notifying him that if IFC failed to respond to the CID by the end of the week, we would forward the matter to the FTC's Office of the General Counsel with a recommendation that it seek judicial enforcement."

Time and Management

A major sales consulting firm estimates that most salespeople spend no more than six percent (6%) of their available working hours talking to prospects and customers in person or on the phone about whether the customer or prospect wants to grow their business or fix a problem in the business. Excluding telemarketers, where then do most salespeople spend their time?

Not surprisingly, effective time management is a challenge for many salespeople and sales managers. What is surprising is how much time and money is spent by sales organizations desperate to teach their sales teams how to spend their work time wisely and efficiently. Even a cursory look at the essential activities of salespeople reveals all you need to know about time management for the sales team.

For most salespeople, there are only six essential tasks for which they are responsible - prospecting, qualifying, facilitating orders, closing business, maintaining customer relationships, and reporting activities to management. With the exception of continuing education, a salesperson can plan his or her days, weeks, months and years around these essential activities. The trick is to exclude as many activities as possible that do not impact at least one of these essential tasks.

Because all companies need revenue, and salespeople are paid to close business, closing business is the number one priority for most salespeople. It seems obvious, then, that salespeople would not let anything stand in the way of closing current business with customers.

Whether a salesperson prospects as a "hunter," or is continually on the lookout for additional opportunities to do more business with existing customers, prospecting for business is the second most important activity for all salespeople.

Why? Without a constant flow of new prospects, or new prospective business from existing customers, a sales pipeline or funnel quickly runs dry.

Once prospects are identified, salespeople must qualify the prospects as a fit for the products or services offered. There are few things in a salesperson's working life that are worse than spending gobs of time with prospects who cannot or will not do profitable business with the salesperson's company.

As business from a number of prospects and customers begins to move through the salesperson's pipeline, time must be spent facilitating activities that cause that business to move toward closing. It's here that salespeople waste most of their time. Whether the salesperson is at fault, or whether operational inefficiencies make it necessary for salespeople to baby-sit order processing, this activity robs many salespeople of precious selling time.

Salespeople must spend some time cultivating and growing their relationships with customers. This essential activity can take many forms, from regular visits to the customer's place of business, researching solutions to customer challenges, to arranging entertainment events like business lunches and dinners, sporting events and so on.

Finally, as bitter a pill as it is for salespeople to swallow, some time must be spent reporting activities and the results of activities to sales management. After all, if sales managers did not receive reports from their team, what on earth would they do with their time? But seriously, management should always require reports from the sales team, not for the purposes of micromanagement, but for the value of the intelligence to be gained from feedback reported by the sales team.

Keeping the main activities of sales in mind - prospecting, qualifying, facilitating orders, closing business, maintaining customer relationships, and reporting activities to management - should help salespeople and managers prioritize and allocate selling time. Does anyone really need a time management class to tell them to do essential selling activities and stop doing everything else during selling hours?

Next week we will examine time traps that rob salespeople of precious selling time, and we'll explore some ways to avoid them.

SAUSALITO, Calif.------Willis Lease Finance Corporation (Nasdaq:WLFC), a leading lessor of commercial jet engines, today announced it is not yet ready to file its Form 10-Q for the quarter ended September 30, 2005, which is due today. As previously announced, the company will restate its financial statements for 2004 and the first and second quarters of 2005. Until the restatements are completed, the company will not be in a position to finalize its financial statements for the third quarter of 2005.

On October 24, the company disclosed that it would restate its financial statements for 2002, 2003, 2004 and 2005 to conform to the accounting requirements of SFAS 133, "Accounting for Derivative Instruments and Hedging Activities." The restatement does not impact the Company's previously reported total assets, total liabilities, total shareholders' equity or total cash flows. The economics of the interest rate derivative contracts are not affected.

The Company expects to file an amended Annual Report on Form 10-K for the year ended December 31, 2004, and amended Quarterly Reports on Form 10-Q for the quarters ended March 31, 2005, and June 30, 2005, with the SEC that will include the restated financial statements and related disclosures and file the Quarterly Report on Form 10-Q for the period ended September 30, 2005 by the extended due date, November 21, 2005.

    1969-News reports charged a U.S. infantry unit with massacre at My Lai 4, a village in the Song my district in South Vietnam , on March 16, 1968. More than 450 villagers including many women and babies were said to have been slain. Pending an investigation, Lt. William L. Calley, Jr. in charge of the U.S. unit at the time, was kept on active duty beyond his official tour. He later would receive several months in jail in one of the many military cover-ups about the war in Viet Nam.

    1620- Fifteen pilgrims lead by Captain Myles Standish, William Bradford, Stephen Hopkins and Edward Tiley discovered corn on the future site of Provincetown, MA. They named the place "Corn Hill." This vegetable would become a staple for the settlers. The Indians also taught them how to make pop corn, a very popular item even way back then.
    1747- Knowles Riot in Boston; hundreds of sailors, laborers & free blacks rise up against British Navy Press Gangs, temporarily forcing an end to impressments in the Royal Navy. Many believe this gave rise to the American Revolution, although there were several such acts of rebellion, none as dramatic as this as it was a "mob act," mostly poor whites and black, and not planned such as the Boston Tea Party.

    1776- Fort Washington on Manhattan Island fell to the British, who took about 2,000 prisoners. Colonial troops were on retreat and the war looked bleak as the weather.
    1776- The first salute to a U.S. Flag (Grand Union Ensign also known as the Continental Union flag) was a volley of 11 guns fired by Fort Orange on St. Eustatius, Dutch West Indies, Leeward Islands today, in 1776. The salute was in response to a volley fired from the "Andrea Doria" commanded by Isaih Robinson. It was saluted by Johannes de Graeff, governor of the colony. The brig was captained by Nicholas Biddle, who had been sent to St. Eustatius to transport arms and ammunition for the American Leasing Army. This was an important event as St. Eustatius was a very important trading center and a supply base for the colonies.
    1777- The second Continental Congress adopted the Articles of Confederation and Perpetual Union. Submitted to the states for ratification two days later. March 1, 1781 they were adopted. Although ultimately supplanted by the United States Constitution, the Articles of Confederation provided stability during the Revolutionary War years and attempted to define "states rights" and "federal authority."

    1864-General William T. Sherman march to the sea with 62,000 men began. Leaving Atlanta, GA., in flames, it was thought the fires were started by Sherman's troops, but historians state most of the major fires were started by Confederates fleeing the city, not wanting to supply the Union troops with food and supplies. Sherman was to seep across a 60-mile front with little serious opposition, his army destroying everything useful to the Confederates, who were doing the same to his army. The South was cut in two. General William J. Hardee and his remaining Confederate forces evacuated Savannah, GA. on December 21. Sherman occupied the city that day.
    1873- Birthday of William Christopher (W.C.) Handy, American composer, bandleader, "Father of the Blues," W.C. Handy was born at Florence, AL. He died at New York, NY, Mar 28,1958. If you can't have but one jazz CD in your collection, let me recommend Louis Armstrong Plays W.C.Handy.

    1892-the University of Chicago won its first football victory. The preceding October 22, they played to a 0-0 tie with Northwestern in its first ever football game and this was their first win for Coach Amos Alonzo Stagg 10-4 against Illinois at Chicago. A founding member of the Big 10, Chicago eliminated its football program for many years, but now competes against the likes of New York University, Emory and Washington University at St. Louis. This Saturday it is the traditional rival game as football fans will switch from channel to channel in perhaps the most heated college game of the year.
    1899-Birthday of Mary Margaret McBride, who from 1934 to 1954 conducted a radio show of astonishing and human interest facts and in 1940 was voted the most popular woman in radio. She was one of the first big radio stars who tried to move to the new media of television where she was declared a big flop. It was the same night Milton Berle became the permanent host of "Texaco Star Theatre," and NBC showcased McBride in the timeslot right after Berle. Early TV's biggest success was a performer who'd never done well on radio--Milton Berle, a vaudevillian. His popularity on TV showed the uncertainty of predicting how radio stars would likely fare on television. "We all knew one thing that wouldn't work," recalled George Burns, also a vaudevillian, about moving from radio to TV: "standing in front of a microphone and reading from a script. Unfortunately, that's what we were best at." She died in 1976.

    1920- The postage meter was officially set at Stamford, CT, by the Pitney-Bowes Postage Meter Company. Although the idea of metered mail originated in 1900, when the American Postage Meter Company was organized in Chicago, it was not until September 1, 1920, that the Post Office Department approved it. About $2 million was spent on research and development of the machine. Today they have a near monopoly on this device. You cannot purchase the meter, you must "rent" it.
