Steve Chriest Number #9 to Create New Agreement Form

“I also will contribute a form used successfully in the past. “

Steve Chriest

Alamo, California

This week we hope to reach the goal of $2,000. In addition,

those donating $200 each are also contributing

their experience and forms that they use.

Here are others that have joined the effort to date:

Ben Carlile

Allegiant Partners Incorporated

Warren Hawkins

Bank Partners

Paul Behechti

Bridge Capital Leasing

Gary Saulter

Chase Industries

Gary Trebels, CLP

IFC Credit Corporation

Theresa Kabot

Kabot Commercial Leasing

Charlie Lester

LPI Financial Services

Mark Watkins

Geneva Capital LLC

The people who are donating $200 to this effort, also are presenting the documents their company  uses today, and their experience.  The form will be generic, and hopefully valid in most states.  It certainly will spell out what is "earned" for working on an application.

While we do not want to give legal advice, particularly realizing that states differ and there are  also licensing issue, we asked Ken Greene for some "generic" help.

He has agreed to perform this service, review the forms, and then devise a "generic one" to help  brokers retain expenses, particularly if an application is not approved or terms and conditions

change.

"I am glad to help if a pool of leasing companies would like to get together and hire me to put  together a thorough form. It can still be simple, but it should be internally consistent and not

appear to be punitive in nature."

For those who participate, Ken Greene is willing to do extra work for a minimal fee on the form for  their specific needs. Each company will sign an agreement regarding this form to cover expenses incurred should a lease not go forward, plus give other clauses for specific terms and conditions  to be covered in the proposal.

Affluent Consumer Confidence Hits Highest Levels in Five Quarters

  U.S. Bank Weekly

Affluent Americans continue to be increasingly optimistic about the current and future state of the economy. However, despite recent stock market gains and signs of economic improvement, they remain cautious, planning to hold fairly steady on spending and investing over the next three months, according to the McDonald Financial Group Affluent Consumer Confidence Index. Factors such as the national deficit, a perceived real estate bubble and lingering concerns about jobs are contributing to this restraint.

The overall index score was 56 out of 100, a 14 percent improvement since the last survey in October (49), reflecting the biggest increase yet in confidence among the affluent in the five quarters since the survey's inception in January 2003.

A full 61 percent of those surveyed said the economy would get better in the next three months, an increase from 59 percent in the October 2003 survey and 39 percent in January of last year. Only 3 percent say it will get worse, down from 6 percent in October and 17 percent one year ago.

The percentage of affluent Americans who say their family's personal economic situation has improved over the past three months, increased to 40 percent in January of 2004 - up from 38 percent in October of 2003 and 14 percent in January of 2003. Additionally, affluent respondents see a much improved business environment, with 73 percent saying business conditions are either "good" or "normal."

  This Day in American History

1773-Birthday of William Henry Harrison, born 1773, the 9th president of the United States ( March 4-April 4, 1841). His term of office was the shortest in our nation's history-32 days. He was the first president to die in office . He was the first Whig president. He refused to wear a jacket during the inauguration.  He made a very long speech, two hours, and contracted a cold which turned into

pneumonia in those days of no antibiotics.  John Tyler assumed the presidency and historians state his administration was characterized by bickering and frustration, primarily caused by Henry Clay and Daniel Webster over political issues in their own "Whig" party.

1799-Off the island of Nevis, West Indies, the 26-gun Constellation met and captured the 40-gun French frigate L’Insurgente, inflicting 70 casualties at the cost of only 4 American casualties.  It was the first warship to capture an enemy ship after the revolution. L’Insurgente was the fastest ship in the French Navy. Under the command of the legendary Captain Thomas Truxtun, it was the first battle by one of the original six frigates. This great achievement for a young U.S. Navy was the first major victory by an American-designed and American-built warship. There were many more victories to follow. CONSTELLATION fought a second single-ship action in February 1800: a night encounter with France’s 54-gun frigate LA VENGEANCE. CONSTELLATION was again victorious, winning a bloody and violent 5-hour battle. French sailors, amazed at her expert sailing ability because she could attain the thrilling speed of 14 knots while sailing under nearly an acre of canvas sails, nicknamed her “Yankee Racehorse.” The Constellation continued to serve with distinction in the  Barbary Wars against Tripoli and the War of 1812 against Great Britain. In 1840, CONSTELLATION completed a historic voyage around the world, which included being the first U.S. warship to enter the inland waters of China. After more than 50 years of service, CONSTELLATION was thoroughly worn out. In 1853 she was broken up at the Gosport Navy Yard in Norfolk, Va.

1819- Birthday of Lydia E. Pinkham, who developed a home tonic of herbs and 19% alcohol that she gave her children. As the tonic grew famous in her neighborhood she made her first sales in 1875 to earn money since she was married to a dreamer whose ship never came in. Later, her son marketed the home remedy under her direction.   By 1879, Lydia's Pinkham's tonic was a flourishing enterprise. She also wrote about women's "ills" in a more sensible fashion than was popular in the day, emphasizing cleanliness, and speaking frankly about menopause, uterine collapse, etc., things that women did not have general access to because of the male medical system.    When the compound was first marketed, many home remedies contained opium and small doses of compounds of mercury and arsenic, which hers did not. Many operations at the time had a 40% mortality rate (and high rate of death in childbirth.) It was during this time that Lydia Pinkham told women to stop visiting doctors, who at the time were popularly recommending nitric acid douches, take her herbal formula, exercise, and eat fresh fruits, vegetables, and grains.

1825- John Quincy Adams was elected president of the United States by the House of Representatives, into which the election had been thrown by the failure of any of the four candidates to win a majority in the Electoral College. In the four-way race of Adams, Andrew Jackson, Henry Clay, and William Crawford had received more electoral votes than Adams, but no majority. Henry Clay, one of the candidates assisted Adams cause in the House.

1849- Laura Clay, daughter of Cassius E. Clay, at the 1920 convention became the first woman to receive a vote for the presidential nominee of the Democratic Party. She was a noted suffrager and first president of the Kentucky Equal Rights Association.

1861 - Jefferson Davis was chosen as president of the Confederate States of America, and Alexander Stephens as vice-president.  The Confederate Provisional Congress asserted that all laws under the U.S. Constitution that were not inconsistent with the constitution of the Confederate states would be recognized. One of the main provisions was, “Congress shall also have power to prohibit the introduction of slaves from any State not a member of, or Territory not belonging to, this Confederacy.”  Perhaps considered trivia today, in section IX     , the first

law: “The importation of negroes of the African race from any foreign country other than the slaveholding States or Territories of the United States of America, is hereby forbidden; and Congress is required to pass such laws as shall effectually prevent the same.”

1872-Birthday of Helen Elizabeth Haines, librarian, championed literary freedom in book selection for libraries and literary concerns over automation and information systems. Her Living With Books: The Art of Book Selection (1935) became a standard text.
