In reading the 9/11 experiences, I couldn't help thinking about my

wife's day. Some people commented that they had just dropped their

kids off at school. My wife is a fifth grade school teacher.

 

Her day started with a panicked call to me and after about 15 minutes of crying

and very serious conversation, she greeted 32 nine and ten year olds.

She did her usual super job of teaching and holding everything

together.

 

Today I think not only of our wonderful country, but of my

wonderful wife and how lucky Rossmore Elementary and I are to have her.

I was on my way to a Doctors Appointment when a vendor I provide equipment

leases for called me on my cell phone. He said, “They did it! They finally

got the World trade Center!”

 

I sat in the waiting room watching it on the big screen TV. When I came out

of the Doctor's office, I noticed that there were no planes in the sky. For the

next 2 days the skies were so silent!

 

It is amazing that my Mother (her 2 brothers served in World War II) still

talks about the Pearl Harbor surprise attack and how angry everyone was that

the United States was attacked, but it seems that 9-11 (just as horrific) is fading

away so fast!

 

The United States has been attacked by an enemy just as EVIL as the World

War II AXIS Powers, but the effect has not produced the resolve Pearl Harbor did!

DVI

 

My contacts at DVI corporate told me that the amount of misappropriations was approximately $80MM. $30MM from the International sector and $50mm

domestic. Another rumor - that DVI double funded deals under the securitizations. Meryll Lynch was too slow to catch on to the business and find these issues.

The big surprise so far - Rich Miller, the President of DVI Financial Services has not been touched. He was aware of all of the problems and was part of the

decisioning. Further, he determined who got funded. How he has escaped prosecution I do not understand. Mr. Miller always accompanied Mr. Garfinkel and

Mr. O'Hanlon during quarterly analysis conference calls - he was part of O'Hanlon's inner core.

With respect to Marlin leasing and for all investors, Piper Jaffray was a regular with DVI and participated in quarterly conference calls. I listened to most of the

calls over the past several years - I never heard Piper asked a hard question. These calls were more like a love feast with DVI. This is another reason why DVI

was able to get away with their deception as long as they did.

Your comments about Marlin and securitization may come back to haunt you. It

sounded like you “endorse” this company.

(Good idea to do a story about securitization today, as many of the companies

who failed went to this market place. I don’t think Marlin will fail, and also

look at Balboa Capital, going strong for many years. Look at Republic Leasing

of South Carolina, before being bought by Netbank, where there business

was exclusively brokers---and their portfolio was super clean. And there is

ICON, Cypress, and ATEL with a different approach. I don’t know, may I allude

to guns. It is not the gun the kills people, but the holder, the mis-use, the

carelessness, that is the culprit. editor )

Hey Folks:

 

Did you really think that a lawyer would have nothing to say about why you need to attend the NAELB California regional meeting in Irvine.

 

There are some very qualified CA attorneys making a presentation about the CA Licensing Requirements that are unique to CA. That is one big reason why people need to attend. With my lawyer's hat on, here's just a couple of thoughts as to why:

Learn about the CA Licensing Laws.

 

If you ever get caught without it, you can be (a) closed by the state, (b) fined by the state and (c) face potential criminal ramifications. Folks choose to live in and do business in CA. CA is a heavily (if not the most heavily) regulated state in the US. Come and learn the reasons for the law, what type of transactions the law applies to so that you can make a fully informed business decision as to whether or not you should obtain the license.

 

Again, if you are required to have it and you don't, you could find yourself selling T-Shirts on Laguna Beach. I guarantee you have to have a license to do that!!!!

 

And bear it mind that the law does not just apply to residents of CA, those transacting business in CA can be subject to the requirement as well.

 

So, take the time and don't miss the NAELB CA Regional. As with all the regional, it will be full of networking and education.

 

And don't forget about the Atlanta Regional Meeting to be held in November.

How to Increase Profit without Raising Price

 

Is Workshop Topic at Leasing Industry Meeting in New Jersey

 

 

TEANECK, N.J., -Shawn Halladay, a veteran consultant and

educator in the global $500 billion equipment leasing and finance

industry, will unveil a new workshop topic that should strike equipment

lessors of all sizes as timely and pertinent: "Enhancing Profitability

without Raising Price."

 

Halladay's presentation is part of Expo XX, a day-long education and

networking program, to be hosted by the Eastern Association of Equipment

Lessors (EAEL) on Monday, September 15, at the Marriott at Glenpointe,

in Teaneck, New Jersey.

A specialist in equipment leasing and finance education since 1985,

Halladay is a principal in The Alta Group and founder of Carpediem

International Learning Services, an international education and training

firm, based in Salt Lake City, Utah.

Given the erosion of profit margins facing the leasing industry,

Halladay's workshop should be of special interest to lessors. Halladay

will lead a discussion that will examine the current market environment

and its constraints, drill down to the very definitions of profit, and

establish the best lessor targets for enhancing profitability. Specific

topics include fees, terms and conditions, security deposits,

end-of-term options, lessee evaluation methods, and structuring

techniques.

 

"Leasing companies have already trimmed their expenses as far as they

can, in terms of reducing staff, technology investment, travel, and

training. To squeeze more profit from their business, they will have to

take a closer look at all sources of profit and methods of earning more

on transactions," he said. "They may have to look at adding insurance

programs, enforcing late payment fees, and other ways of ensuring a

stronger bottom line," Halladay says.

The Equipment Leasing Association of America (ELA) reported in its

just-released "Survey of Industry Activity" that profitability

deteriorated during 2002, with pre-tax yields-which include the internal

rate of return on new business, including tax benefits and booked

residuals, net of fees paid to brokers and vendors-at 8.1 percent, down

from 10.2 percent reported in 2001.

 

Halladay often includes the topic of profitable deal structuring in

public and private corporate training programs, and his company offers a

two-day program on lease pricing. But his appearance at Expo XX marks

the first time Halladay has condensed this subject for a 90-minute

workshop.

 

Halladay is also known in the industry as an author of many books and

articles on equipment leasing, including A Guide to Equipment Leasing,

An Introduction to Leasing, and The Handbook of Equipment Leasing. In

addition, Halladay consults extensively for companies large and small on

a broad range of topics. His primary expertise lies mainly in financial

and accounting issues.

The second site is a block form my office on a very busy highway on the corner of the San Jose International Airport. I often eat my lunch here, as I find it “peaceful” despite the noise. I have been

to weddings and funerals at the existing mission, which holds quite a mystique as it is told

Indians. The missionaries severely punished Indians who did not conform to the Spanish

culture. It is said the Indians were afraid of the Padre, who planted grapes, made wine

and beer, and lived off the work of the Indians as donations to the church.

    1808- The Holy Bible was translated into English by Charles Thomson and printed in Philadelphia, PA by Jane Aitken. “The Holy Bible, containing the old and new covenant, commonly called the Old and New Testament; translated from the Greek.” It was copyrighted in the District of Pennsylvania by the translator, Charles Thomson, who had been secretary to the Continental Congress.

    1814- Battle of North Point fought near Baltimore during War of 1812 9,000 troops British troops land at North Point . They had taken Washington, DC,

and wanted to also burn Baltimore, which they called “the nest of pirates”.

Fort McHenry stood in their way. Major General Robert Ross, riding ahead

of his troops with his personal platoon, thinking this was a “walk in the park,” rode right into General John Stricker, 3,200 men, was only two miles away with his six cannon in place across Long log Lane (North Point Road) waiting for the British, who unlike the Capital, knew they were coming and were prepared to fight. Shots were fired by both sides. Two Americans, Dan Wells and Henry McComas, were instantly killed. They are credited with shooting General Ross. He was 48 years old. (The spot where Ross was shot is marked today by a monument erected to honor Aquilla Randall as the first American killed in the battle. It’s still there today, at Old North Point Road near Battle Grove Road.)

The death of General Ross was a devastating blow to the British. The also had lost their surprise. Although they outnumbered the Americans, the battle went against them and they retreated. After resting, they turned direction and ran into over 10,000 men and over 60 cannon behind well-made breastworks, ready and waiting to repel any attack. After two short rallies, they took to retreat again. The British were unable to take Fort McHenry ( Francis Scott Key wrote the “Star Spangled Banner.”)

    1843- the first minstrel troupe in New York City was formed by Daniel Decatur “Dan” Emmett, who later wrote the song “Dixie.” His quartet of blackface singers and musicians played in several Bowery theaters and established many of the basic routines followed by later minstrel shows.

    1851- Birth of Francis E. Clark, American Congregationalist clergyman. In 1881, at age 29, Clark organized the world's first church "youth fellowship" in Portland, Maine. Clark's original name for this Christian group concept was "The Young People's Society of Christian Endeavor."

1866- the first burlesque show was opened at Niblo’s Garden, New York City. The musical show was produced by Barras and William Wheatley and featured 100 scantily clad young women playing a troupe of dancing fairies. It ran for an unprecedented 16 months, closing on January 4, 1868, after playing 475 performances and grossing $1.3 million. It was in four acts and titled “The Black Crook.”

    1880- birthday of H.L.Mencken. American newspaperman, lexicographer and critic, “the Sage of

Baltimore” was born at Baltimore, MD, and died there Jan 29, 1956. “If, after I depart this vale,” he wrote in 1921 (Epitaph, Smart Set), “you ever remember me and have thought to please my ghost, forgive some sinner and wink your eye at some homely girl..” My mother told me sat on his

lap when I was very little, and quite the contrary, he was a very likeable person.

    1889-American aeronaut of French extraction, born in New York, NY, about 1857, achieved world fame as a parachutist. After his first public performance ( Philadelphia, PA,1887), he toured European cities where his parachute jumps attracted wide attention. Credited with 238 successful jumps. He was last seen this day as he jumped from a balloon over Tallinn, Estonia, and perished in the Bay of Reval.

    1913- James Cleveland (Jesse) Owens, American athlete, winner of four gold medals at the 1936 Olympic Games at Berlin, Germany, was born at Oakville, AL. Owens set 11 world records in track and field. During one track meet, at Ann Arbor, Ml, Owens, repre­senting Ohio State University, broke five world records May 23, 1935, and tied a sixth in the space of 45 minutes. Died at Tuc­son, AZ, Mar 31, 1980.

    1928 - Actress Katharine Hepburn made her stage debut. The play was titled "The Czarina". It would be four years before the ‘First Lady of the American Screen’ would indeed, make her first film, "A Bill of Divorcement".
